Align Technology, Inc. and its affiliates ("Align", "we", "us", and "ours") are committed to protecting your personal information (in this Privacy Statement, "personal information" refers to the personally identifiable information, including but not limited to personal data, that you provide us, or we collect about, or from you, through our websites).

 

Align designs, manufacturers and markets the Invisalign® System, iTero® intra-oral scanners, and OrthoCAD services. This Privacy Statement sets out how we may collect, use, and disclose the personal information we gather on our websites, and/or any official social media channels created by Align on any social media platform (including, without limitation, Facebook, Twitter, YouTube, Instagram, Pinterest, Google+, WeChat, Weibo, Youku) (collectively referred to as the "Sites").

 

In general, you can visit our Sites without telling us who you are or revealing any personal information about yourself. There are times, however, when we may seek personal information from you, about yourself, or about someone you know, such as a name, email address and/or home address. We intend to let you know before we collect such personal information from you on the Internet and to get your informed consent to process such personal information where required.

Personal information we collect from you

 

We may collect personal information of our customers, patients (former, potential and current), patients’ parents/guardians, doctors, dentists, orthodontists and other medical or healthcare practitioners, and/or visitors of our Sites; for instance, when they register to become a member of any of our Sites, via on-line forms, when they post content on any of our Sites, or when they sign up to receive news alerts from us or to undergo an assessment using the Quick Compatibility Tool feature on any of our Sites. The kinds of personal information collected from visitors of our Sites that are patients (former, potential and current) includes name, contact information, date of birth and health information about teeth alignment.

We may also collect personal information of doctors, dentists, orthodontists and other medical or healthcare practitioners; including but not limited to their names, profiles, practice names, addresses, phone numbers, website URLs, and other details such as their tier experience, for specific purposes such as to provide services to our consumers, customers, and other users of the Sites, listing them on our Find a Doctor, to allow potential patients to find an Invisalign provider, and/or for any purposes that may be specified by Align.

We may also collect personal information about your use of our Sites as described in the section "Cookies and Advertisements" below.

There may be features on the Sites for which provision of your personal information to us may be mandatory, and if so, where you do not provide us with the required information, we may not be able to provide you with the associated products and/or services.

On occasions you may choose to provide us with personal information about other people so that, for example, we can contact them with information about us. By sharing their personal information with us, you undertake that you have obtained their consent and permission to do so.

 

What do we do with the personal information we collect?

 

As a customer, doctor, dentist, orthodontist and/or other medical or healthcare practitioner, the personal information we gather from your use of our Sites or provided by you may be used:

  • To set up and otherwise manage your member account in our Sites.
  • To allow you to use, purchase, book, and/or download products and services, such as the purchase of supplies.
  • To provide you with information about our products, services, news, and events.
  • To invite you to take part in our surveys or become a member of a fan club (where applicable).
  • To provide you with information on actual or prospective patients.
  • To analyse use of our services and products, develop new services and products, and customize our products, services, and other information we make available.

As a patient (former, potential and current), patient’s parent/guardian or visitor of any of our Sites, the personal information we gather from your use of our Sites or provided by you may be used:

  • To allow you to use, purchase, book, and/or download products and services, such as the purchase of supplies.
  • To provide you with information about our products, services, news, and events
  • To provide you with details of doctors, dentists, orthodontists and other medical or healthcare practitioners, including, but not limited to, their name; profile; practice name, address, phone number, and website; and additional details of the practice such as tier experience), that are near your selected location, and to allow you to submit contact requests to them.
  • To invite you to take part in our surveys or become a member of a fan club (where applicable).
  • To gather demographic information about user trends, such as age, gender, and general income levels.
  • To analyse use of our services and products, develop new services and products, and customize our products, services, and other information we make available.
  • To generate preliminary compatibility assessment reports to help determine if you could be a suitable candidate for Invisalign treatment.
  • To allow you to submit questions or complaints to, and/or engage with Align representatives about, Invisalign services, including the benefits, cases, treatment process, etc. We use a robust combination of data sources (e.g. online, orders, customers) to get a full picture of our products and marketing efforts. This data is only for our efforts, and we do not share your personal information with other businesses for them to use it for purposes other than their work with us.

 

Who we share your personal information with

 

We may partner with other businesses to assist us in our marketing, communications, and sales efforts, and may share personal information about you for these purposes where you have given us consent to do so or where permitted by law. These partners are not allowed to use your personal information for any purpose other than doing business with Align.

In addition, any information we collect, including personal information, may be disclosed as part of any merger, acquisition, debt financing, sale of company assets, or similar transaction, as well as in the event of insolvency, bankruptcy, or receivership in which personal information could be transferred to third parties as one of our business assets.

We may also disclose personal information about you if we believe that doing so is legally required or is necessary to protect our property or other legal rights (including but not limited to enforcement of our agreements or the rights of property of others).

If you do not wish to have cookies placed on your computer while browsing the Sites, please set your browsers to refuse cookies before using the Sites. Please note that certain features of the Sites may not function properly without the aid of cookies.

 

Children's Privacy

 

At Align, we do not intend to collect any personal information about children under the age of thirteen (13), unless that personal information is collected from a parent or guardian. However, we cannot stop children under the age of thirteen (13) from accessing the Sites. In the event that you provide your child’s personal information as above, you hereby consent to the processing of his or her personal information in accordance with applicable laws, and agree to be personally bound by the terms of this privacy statement. You will also take full responsibility for the actions of your child in relation to any use by him or her of the Sites.

Align is not responsible for the privacy practices or the content of such other websites, and inclusion of links does not mean we endorse the information or company. This means that if you connect to another site through our Sites, we are not responsible for – and we cannot control -what they do with your personal information.

Also, you may have the opportunity to share your personal information with other websites, such as social media sites. We may provide a convenient link to let you do this easily, but we are not responsible for – and we cannot control – their website or your posts/sharing. You are encouraged to review the privacy policies and personal information collection practices of these other websites and social media sites.

 

Marketing and Do Not Contact

 

We may send you information about us from time to time if you have given us your consent (where required).

Align provides you the opportunity to request to stop receiving electronic communications from either Align or our partners by withdrawing your consent. If you do not want to receive communications from us, you may use the convenient unsubscribe feature included with emails. Please allow us time to process your request.

Keep in mind, this withdrawal of consent does not apply to necessary communications, such as responding to an inquiry, and is revoked if you later request information from us (e.g. if you subsequently sign-up to receive news alerts from us).

 

Social Media

 

User-Generated Content. If you are a user of Facebook, Twitter, and/or other social media sites with public account settings and you use any hashtags which may be related to Invisalign or any of its campaigns and/or products or services, we will be able to pull your reviews of our products from the social media sites and post them on our other Sites. This is so that we can share your opinions about our products with the visitors of our Sites. Before being posted in our Sites, your comments will be reviewed by us. You hereby agree not to use these hashtags if you do not wish for your reviews to be made available on our Sites.

By posting or otherwise making available any content on a social media platform about your Invisalign experience, and responding “yes” if we ask for your permission to repost content on any of our Sites (including any official Align social media channels, such as on Facebook, YouTube, Google+, Instagram, Weibo, WeChat, and others), you represent and warrant that you are thirteen (13) years of age or older and that you agree to the terms and conditions listed on our page on those websites.

International data transfers

 

Align operates globally and may therefore transfer your personal information to other countries, including countries other than your country of residence. Your personal information may also be stored on our servers which may be located outside your country of residence. However, we will continue to protect your personal information in accordance with this Privacy Statement and our Binding Corporate Rules.

Storage and Security

 

We store your information at our offices and may also store such information with a third party data storage provider. We link personal information we collect about you with other information held about you to get a full picture of our products and marketing efforts.

Our Sites have security measures in place to try to protect against the destruction, loss, misuse and alteration, unauthorised disclosure, or access of the personal information under our control. Our web portals, such as the Invisalign Doctor Site, transmit patient personal information securely via HTTPS. These portals require customer accounts and are not available to the general public.

It is our policy to only retain your personal information for such period as may be required for any of the above mentioned purpose(s), and thereafter, we will take steps to destroy such personal information promptly, including ensuring that electronic files which contain personal information will be permanently deleted using a technical method that makes the files irreproducible and that any other records, print-outs, documents or any other recording media is shredded or incinerated to ensure that the personal information contained therein is irrecoverable and irreproducible.

 

Your Rights

 

To learn more or to exercise any of your personal information privacy rights concerning access, disclosure, amendment, or deletion (as determined and to the extent permitted by local applicable law), please make a submission using our Privacy Rights Web Form.

For example, in California, once per calendar year individuals may request a list of disclosures we make to third parties for their direct marketing efforts. It is not our practice to sell or lease any personal information to other companies for their direct marketing.

In Europe, individuals may contact us regarding their rights to access their personal information, among other rights.

In Singapore, you may generally request for us to provide you with information about the ways in which your personal information that is in our possession or under our control has been or may have been used or disclosed by us within a year before the date of the request. Any access request may be subject to a reasonable fee to meet our costs in providing you with details of the personal information we hold about you, and we will notify you of what such fee will be after receiving your access request.

In Australia, amongst other rights, you have a right to request access to your personal information and request its correction.

How to make a privacy complaint

 

If you wish to make a complaint about our handling of your personal information, please contact us using the contact details in the 'Contact us' section at the end of this privacy policy.

We may ask you to put your complaint in writing. We will investigate and respond to your complaint as soon as is practicable after we receive it (usually within 30 days).

If you are not satisfied with our response to your complaint, you can refer it to the relevant regulatory authority. Please contact us for the name of the relevant regulatory authority in your country.

We may update this statement from time to time. When we do, we will list the last updated date at the beginning of the statement. Notice of such update and/or modification will be provided on our Sites or to you directly if required by law.
